About Cookies

What are cookies?
Cookies are small text files that are saved on your computer by websites you visit. Cookies are used on many websites to provide visitors access to various functions. The information contained in a cookie can be used to track where a user goes on the internet.

There are two types of cookies. The first type saves a file for a long time on your computer. One function it is used for, for example, is to tell you whats new on the website since you last visited it. The other type of cookie is called a session cookie. Whilst you are surfing a site, this cookie is temporarily stored on your computer to e.g. keep track of the language you have chosen. Session cookies are not stored for a long time on your computer but disappear when you shut down your web-browser.

What does the Act say?
Chapter 6, Section 18, Paragraph 1 of the Electronic Communications Act states that:

It shall be permitted to use an electronic communications network to store information, or to obtain access to information that is stored in a subscribers or end-users terminal equipment, only if the subscriber or user receives information from the data controller as to the purpose of the processing and is given the opportunity to prevent such processing. This does not prevent such storage or access that is needed to perform or facilitate the transfer of an electronic message via an electronic communications network or that is necessary to provide a service which the user or subscriber has expressly requested.

When shall information on cookies be provided?
Information need not be provided before the user visits the website but may be given during the time s/he is on the site. This presupposes that the website uses cookies which the user can disable by altering his/her web-browser settings. You can set up your web-browser to automatically disable cookies or to inform you that a website uses them. User information should be placed so that it is clearly visible on the website.
